Welcome to Global Apostille (referred to as “we”, “our”, or “us”). These Terms and Conditions govern your use of our website and the document apostille, legalization, translation, and courier delivery services we provide (collectively, the “Services”).
By accessing our website or placing an order with us, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services.
1. Scope of Services
1.1. Global Apostille acts as an intermediary and coordinating agency that facilitates the processing of document apostilles, notarizations, consular legalizations, certified translations, and related bureaucratic procedures through our network of local agents and partners worldwide.
1.2. We do not issue government certificates, stamps, or official seals ourselves; rather, we submit, manage, and expedite your documents through the relevant competent authorities, embassies, ministries, or courts on your behalf.
2. User Representations and Document Responsibility
2.1. You warrant and represent that:
- All documents submitted to us for processing are authentic, lawful, and legally obtained.
- You are the rightful owner of the documents or have explicit, legal authorization from the owner to request these services.
- You will not use our services for any fraudulent, illegal, or unauthorized purposes. 2.2. We reserve the right to refuse the processing of any document that appears suspicious, altered, forged, or violates local or international laws. In such cases, the client will be notified, and administrative fees may apply.
3. Orders, Pricing, and Payment
3.1. The total cost of our services is communicated to the client in advance and presented in the form of quotations. Unless otherwise agreed in writing, services must be paid for in advance.
3.2. Payment methods accepted include major credit/debet cards and other electronic payment gateways securely integrated into our platform.
3.3. Pricing includes our agency fees, partner agent fees, and official government/embassy fees where specified. However, any unforeseen official fee increases by government authorities after an order is placed may require an additional payment from the client.
4. Processing Times and Delivery
4.1. Estimated processing times provided on our website are approximate and based on average timeframes reported by relevant authorities and local partners.
4.2. Global Apostille is not responsible for delays caused by government bodies, embassies, public holidays, postal/courier disruptions, or force majeure events.
4.3. Delivery of completed documents is carried out via trusted international courier services. Risk of loss or damage to documents passes to the client upon handover to the courier. We recommend using trackable, insured shipping options.
5. Cancellations and Refund Policy
5.1. Order Cancellation by Client: You may cancel your order only if processing has not yet commenced (i.e., documents have not been submitted to our agents or authorities). Once an order or processing has started, fees are strictly non-refundable.
5.2. Rejection by Authorities: If a government agency or embassy rejects a document due to reasons originating from the document itself (e.g., damage, illegibility, incorrect prior issuance, or lack of underlying civil registry validity), our service fees and government fees are non-refundable.
5.3. Our Error: If an error is made directly by Global Apostille or our local agents during the processing phase, we will correct the error or re-process the document at our own expense as quickly as possible.
6. Limitation of Liability
6.1. To the maximum extent permitted by applicable law, Global Apostille, its directors, employees, and local agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising out of or related to your use of our services.
6.2. In the event of loss or severe damage to physical documents while in our physical custody or our partner agents’ custody, our maximum liability shall be limited strictly to the official government re-issuance costs of those specific documents. We strongly advise clients to retain digital copies or certified backups of all critical documents.
7. Privacy and Data Protection
7.1. We collect, store, and process your personal information and uploaded documents strictly in accordance with our Privacy Policy.
7.2. By using our services, you consent to the transmission of your documents and personal data to our local agents, translators, and relevant government authorities solely for the purpose of executing your requested service.
8. Changes to Terms and Conditions
8.1. We reserve the right to modify or update these Terms and Conditions at any time. Changes will take effect immediately upon being posted on website. Your continued use of the website following any changes constitutes your acceptance of the revised terms.
9. Dispute Resolution
Any disputes arising out of or relating to these terms or our services that cannot be resolved through negotiations shall be resolved by the competent courts in Baku, by the competent courts of the Republic of Azerbaijan.
